I thought the Utah Legislature banned abortion. How is it still legal?
Court injunctions have blocked abortion bans passed by the Utah Legislature from taking effect. These injunctions have allowed abortion to remain legal in Utah. On August 1, 2024, the Utah Supreme Court rejected Utah’s request to overturn the injunction blocking the Trigger ban. This decision means that abortion care continues to remain legal in Utah up to 18 weeks of pregnancy, as it has since June 2022.
What happens next?
The Trigger ban will now be litigated in district court while the injunction continues to block it from taking effect. Abortion care is legal for up to 18 weeks in Utah during the district court trial. We will continue to fight in court for Utahns’ abortion care.
